The access, navigation and use of the www.busup.com website  (hereinafter, the "Website") implies the acceptance of the user, expressly and without reservations, of all the terms contained herein. This document is hereinafter referred to as "Terms and Conditions" interchangeably. 

 

The observance and fulfillment of the provisions of the Terms and Conditions will be enforceable with respect to any person who accesses, browses or uses the Website. If you do not agree with the terms set forth, do not access, browse or use any page of the Website.

 

By using the Website you undertake, therefore, to use the contents in accordance with current legislation and with these Terms and Conditions, and acknowledge and accept that the use of the contents offered on the Website will be at your sole risk and / or responsibility.

Services provided by the holder

 

BUSUP is an entity dedicated to the offer, reservation and contracting of various occasional road passenger transport services (hereinafter, the "Transport Services"), whose technical execution will fall on third party carriers independent  of BUSUP (hereinafter, "Transport Operators"). 

 

In order to facilitate the contracting of the Transportation Services, BUSUP  makes available to users a page that allows, among others, the submission of requests for the Transportation Services, the configuration of preferences for filtering and the receipt of such requests by BUSUP (hereinafter, the "Platform")).  

 

To be able to download the Plataforma, you must necessarily have a desktop computer, a mobile device and / or tablet, with the specifications and technical configurations necessary for proper operation and with an Internet connection. The costs relating to the connection shall be borne exclusively by the user.  You can download our Platform available on Google Play and App Store for free.

 

Additionally, users may have access to a varied offer of suppliers, products and services that BUSUP, where appropriate, decides to offer at any time. 

 

 

OBJECT


These Terms and Conditions regulate the access, navigation and use of the Website.  BUSUP reserves the right to make, at any time and without prior notice, any modification or update of the contents, these Terms and Conditions and, in general, any elements that make up the design and configuration of its Website.

 

However, access to certain content and the use of certain services may be subject to certain particular conditions, which will be, in any case, clearly displayed and must be expressly accepted by users. These particular conditions may replace, complete or, where appropriate, modify these Terms and Conditions.

 

BUSUP reserves the right to modify the Terms and Conditions stipulated herein, totally or partially, publishing any change in the same way in which they appear here or through any type of communication addressed to users. 

 

 

SERVICES PROVIDED THROUGH THE WEBSITE


The Website is considered a means to offer users information about the services offered, as well as an online service channel through which they can access the following services:  

 

Information related to the different solutions offered by BUSUP.
Contact channels for users, customers and transport operators who want to join BUSUP.

 

Access to and navigation on the Website do not require registration, although to receive information, advertising and periodic offers of our promotional campaigns and our products, it may be necessary to complete the forms located on the Website, as long as you previously authorize it. 

 

 

GENERAL PROHIBITIONS


It is strictly forbidden to communicate information or content through this Website that:

  • They can be considered as a violation in any way of the fundamental rights to honor, personal and family privacy or the image of third parties and, especially, of minors.
  • Include photographs or collect images or personal data of third parties without having obtained the appropriate consent of their owners.

INTELLECTUAL AND INDUSTRIAL PROPERTY AND IMAGE RIGHTS


BUSUP owns or, where appropriate, has the corresponding licenses, on the intellectual property exploitation rights of the Website, as well as the intellectual property rights over its information, materials and contents, including, among others, source code, designs, navigation structure, images, graphics, music, sound, photographs, videos and texts written in any language,  including, also, programming codes.

 

In no case shall it be understood that the access, navigation and use of the Website by the user implies a waiver, transmission, license or total or partial assignment of any intellectual property right by BUSUP.

 

No content of the Website may be modified, copied, distributed, framed, reproduced, republished, downloaded, extracted, displayed, posted, transmitted or sold in any way or by any means, in whole or in part, without the prior written consent of BUSUP. Any other use of the content of the Website is also strictly  prohibited, with the sole exception of use in the strictly domestic sphere.

References to trademarks or registered trade names, or other distinctive signs, whether owned by the Provider or  by third parties, implicitly prohibit their use without the consent of the Provider or their legitimate owners. At no time, unless expressly stated otherwise, access, navigation or use of the Website and / or its contents gives the user any right over distinctive signs included therein.

 

Likewise, it is forbidden to delete or manipulate the indications of copyright or other credits that identify the holders of rights of the contents that the user finds on the Website, as well as the technical protection devices, fingerprints, or any protection mechanism or information incorporated into the contents offered on the Website.

 

In the event that the user sends information of any kind to BUSUP through any of the channels enabled for this purpose, the user declares, guarantees and accepts that he has the right to do so freely, that said information does not infringe any intellectual property right, industrial, trade secret or any other rights of third parties, and that said information is not confidential or harmful to third parties.

BUSUP does not authorize the establishment of a link to this Website from other web pages that contain materials, information or content that is illicit, illegal, degrading, obscene and, in general, that contravene laws, morality or public order, or generally accepted social norms.

 

BUSUP does not have the power or human and technical means to know, control or approve all the information, content, products or services provided by other websites that have established links to this Website.

 

BUSUP does not assume any type of responsibility for any aspect related to the web pages that establish that link to this Website; Specifically, by way of example and not limitation, on its operation, access, data, information, files, quality and reliability of its products and services, its own links and / or any of its contents, in general.

 

In any case, BUSUP reserves the right to prohibit links to the Website and to demand their removal when they do not meet the conditions required in this section.

Consequently, BUSUP cannot assume any type of responsibility for any aspect related to the web page to which a link could be established from the Website, specifically, by way of example and not limitation, on its operation, access, data, information, files, quality and reliability of its products and services, its own links and / or any of its contents,  in general.

 

In this sense, if users have effective knowledge that the activities carried out through these third-party websites are illegal or contravene morality and / or public order, they must immediately notify BUSUP so that it can proceed to assess whether it is necessary to disable the access link to them,  action that, where appropriate, will be carried out in the shortest possible time.

 

In any case, the establishment of any type of link from the Website to another external website does not necessarily imply that there is any type of relationship, collaboration or dependence between BUSUP and the person responsible for the external website.

 

Likewise, BUSUP makes available to users, through different tools and applications, means of link that allow users to access the channels and pages of the Website that the Provider maintains on different platforms and social networks belonging to and / or managed by third parties (eg Facebook, Twitter, Instagram, etc.). The inclusion of these links on the Website has the sole purpose of providing users with access to these channels on the different platforms and social networks.

Unless expressly stated otherwise, the BUSUP does not share with Facebook, Twitter or any other social network that is incorporated in the future any type of private information about its users, its sole purpose being that it is established in these Terms and Conditions, as well as in the Privacy Policy of the Website. In this sense, all the information that the user wishes to provide to these platforms will be under his own responsibility, not intervening the Provider in said process.

 

The activation and use of these applications may entail the identification and authentication of the user (login/password) on the corresponding platforms, completely external to the Website and beyond the control of BUSUP. By accessing these external networks, the user enters an environment not controlled by the Provider, so  the Provider will not assume any responsibility for the security configuration of such environments.

 

Since the Provider  has no control over the content hosted on these channels, the user acknowledges and accepts  that the Provider assumes no responsibility for the content or  services that the user can access on these pages, nor for any content, products, services, advertising, or any other material available on them. For this reason, the user must exercise extreme caution in the assessment and use of the information, content and services existing in the linked channels, and on their own or third-party information that they want to share in these channels.

 

 

RULES OF USE OF THE WEBSITE


It is not allowed and, therefore, its consequences will be the sole responsibility of the user, access or use of the Website for illegal or unauthorized purposes, with or without economic purpose. In particular, and without the following list being absolute, it is prohibited:

Even if there is no claim from a third party, BUSUP reserves the right to prevent access to the Website or the possibility of participating in the spaces enabled therein to users who fail to comply with these conditions.

 

 

RESPONSIBILITIES AND GUARANTEES


BUSUP cannot guarantee the reliability, usefulness, timeliness or veracity of absolutely all the information on the Website. 

Consequently, BUSUP does not guarantee and is not responsible for: 

  • The veracity and continuity of the contents displayed on the Website; 
  • The absence of errors in such contents; 
  • The absence of viruses and/or other harmful components on the Website or on the server that supplies it;
  • Damage caused to the computer equipment of users or third parties during the provision of the Website service; 
  • The invulnerability of the Website and/or the impossibility of violating the security measures adopted therein; 
  • The lack of usefulness or performance of the contents of the Website;

However, BUSUP declares that it has adopted all the necessary measures, within its possibilities and the state of the art, to guarantee the functioning of the Website and minimize system errors, both from the technical point of view, and of the contents published on the Website.

 

If the user becomes aware of the publication of any inaccurate, outdated and false data or the existence of any illicit, illegal, contrary to law content or that could involve an infringement of intellectual or industrial property rights, the applicable regulations on personal data protection and / or any other right,  you must immediately notify BUSUP so that it can proceed to take the appropriate measures.

 

 

DEVICES AND SYSTEMS


In order to use the Website, the user must have an Internet connection and a device with a browser compatible with the Website. The  user is responsible for all costs associated with such connection, including those costs derived from data traffic, regardless of where  the user uses the Website.

The Website is available for the following browsers:

  • Microsoft Edge.

We may stop supporting any of the browsers at any time at our discretion. When a browser is no longer supported, we will stop dealing with problems that users may encounter. Also, you should not have any pop-up blockers.

 

To have a good user experience, a connection speed of at least 3MB/s is necessary. In no event shall BUSUP be liable for Internet overload or failures due to problems related to users' equipment or networks.

 

 

CONFIDENTIALITY AND DATA PROTECTION


The visit to the Website does not oblige the user to provide any information about himself, except for certain functionalities of the website that depend on the use of Cookies, as reported in the Cookies Policy.

 

However, to use or access certain content, users must previously provide certain personal data, as reported in the Privacy Policy.

 

 

PARTIAL NULLITY


If any clause included in these Terms and Conditions is declared totally or partially null or ineffective, such nullity or ineffectiveness will only affect said provision or the part of it that is null or ineffective, subsisting these Terms and Conditions in everything else, and such provision being considered totally or partially not included.

 

 

JURISDICTION AND APPLICABLE JURISDICTION


Whenever the regulations in force for this purpose provide for the possibility for the parties to submit to a specific jurisdiction, for any litigious matter derived or related to this Website, the Spanish legislation in force at the time of the litigation will apply, and we will submit to the Courts and Tribunals that are territorially competent according to current legislation,  as well as, where appropriate, to the Consumer Arbitration Tribunals or similar to which we are adhered at the time of the dispute.

 

In the event that any provision of these Terms and Conditions is declared null or unenforceable, in whole or in part, by any Court, Tribunal or competent administrative body, such nullity or non-application will not affect the rest.

 

The non-exercise or execution by the Provider  of any right or provision contained in these Terms and Conditions will not constitute a waiver thereof, unless acknowledged and agreed in writing by the Provider.
